Mahindra XUV 500 absence in Rajasthan attracting resentment among car buyers

Mahindra’s latest global SUV – Mahindra XUV 500 - was in news recently again! Not for 25,000+ bookings, not for its winning the Dakshin Rally and not for fetching exceptional sale in comparison to Mahindra Scorpio, Mahindra Bolero or Mahindra Xylo, this time it is related to some legal issue. As per the information available, some individual from Rajasthan has filed a petition with the Competition Commission of India (CCI) for not delivering the car to him and said that since the XUV 500 is not launched in the state, car buyers had to buy it from Delhi or other states and had to bear additional taxes.

However, the Competition Commission of India (CCI) has turned down the application stating that such an issue is not under the jurisdiction of the Commission and it is a matter of Consumer Protection Act and that the petitioner should move the Consumer Court. Significantly, when the XUV is launched in almost all the prominent states and when Mahindra cars sell like hotcakes in Rajasthan, the XUV 500 is still awaited in Rajasthan and the car buyers had to go to Delhi or some other state in order to by one. Due to this the car buyers have to pay the additional tax levied by Rajasthan government that makes the global SUV more costly.

The petitioner Sanjeev Pandey who is a resident of Rajasthan had moved the Competition Commission of India (CCI) recently contending that Mahindra had not delivered the XUV 500 he had booked. Alongside he also contended that by buying from other states, the car buyers had to pay extra taxes and said that it is against the consumer rights. However, the Commission clarified that if it had been a case related to competitive pricing of the car then the commission would have intervened and thus it has asked the Pandey to move the Consumer Court on the issue.
